Did you absolutely prove it didn't work? Even if you had, you would need to return the item with tracking to get a refund. That's the risk and it's well stated in PayPal policies.
On the other hand, why didn't you investigate options and file a claim for item not delivered? As there was no tracking it was never officially delivered. As a savvy buyer, you need to know the rules and know how to use them to your advantage.

Apparently PayPal didn't not believe your absolute proof of not working wasn't adequate to meet the significantly not as described level for a refund. Even if you had won, you would still had had to return with tracking to get a refund through PayPal. So you were doomed to loose that dispute, no matter what "proof" you had.
Again, why didn't you file f non-receipt with PayPal? Was there tracking to show officially delivered?

The email is irrelvant for delivery; it must be a tracking number part of the PayPal transaction. Check it out in the PayPal policies for buyer/seller protection. Just follow the PayPal rules, not the seller statements.

This is why dealing with virtual items is risky and PayPal is not a good venue for such.
PayPal requires tracking to show delivery; since tracking cannot be included with digital sales, sellers lose automatically on non-delivery claims. Some sellers, however, are a little more astute and mail a tracking letter when a virtual item is sold. This tracking number is all that PayPal requires; PayPal can't verify envelope contents.
But, if you know and undertand the risks your losses should be less.
Just make sure you understand the polcies and the risks.
This was an expensive learning experience.
