mistakenly did gift option - item never arrived no tracking, etc - now I want a refund

On June 27 I sent an individual $275 for an item he was selling.  Unfortunately I mistakenly selected gift friends..  As of today three weeks later, I never received the item nor has he refunded my funds. I never received a tracking number and I have no proof of shipping. It’s an unfortunate situation - I don’t think he’s purposely or knowingly malice or defrauding, but his lack of follow though providing a tracking number is poor business and his poor follow through is simply gross negligence. He says it’s lost in the mail, but I have no proof of shipment and without a tracking I / he can’t open a lost item case with USPS (i mentioned to him it’s a federal offense to steal or accept packages addressed to someone else)

 

I have a few emails and text converstion when he keep saying he'd send tracking then would never follow throug, said he'd do a refund but never did.  Just more excuses, etc --- Is there a way to flag his account, hold is account OR simply get me a refund?

 

What are my options?

It is against PayPal policies to send money as family/frends when it is really for a purchase; that is fee avoidance.

 

So, by contacting PayPal you would be informing PayPal that you violated PayPal polcieis.

 

If you paid with a credit card you could dispute there.

Yea I guess you can say fee avoidance ... I just assumed that the other party (the seller) would end up paying.  Guess I didn't clearly understand the difference.

Paypal cannot help you,only your credit card issuer can,if you use credit card via Paypal to pay him.

Seller does not have to ship with tracking,it is for his benefits to get seller protection,but in your case,he does not need seller protection,he did not sell you anything,you gifted him with $275.

Is this an Ebay transaction,if so ,you may be able to file with Ebay.

go to your Ebay account,look up that order ,is it marked paid?

if so,click on resolve a problem and open a case of item not received.
