Refund for item don't receiced

Hi,

    My item was missing or hold in ICS USPS centre, I ask USPS, they replyed me only the sender can track the problem.

 Please accept my sincere apologies for the delay of your International mail item.  

 The exchange of international mail is governed by the Convention of the Universal Postal Union (UPU) and the Postal Parcels Agreement, to which all member countries are signatories. The Convention and the Agreement set forth the methods of exchange, the inquiry procedures, the limits of liability, the determination of responsibility, and the payment of indemnity for international mail articles.

Per UPU regulations, inquiries on articles mailed to international destinations must be filed by the sender with their own postal administration. Therefore any inquiry about this item must be initiated by the sender through the postal administration in China. This remains true even though this item was last scanned in the U.S.

I contact with the seller, they don't reply me. Can I file a claim for refund.

Contact the seller and if no luck then file a dispute for non receipt of item.
