Paypal not on the side of fraud victims!

Hi, I wonder if someone can help here, I'm absolutely gobsmacked with the way Paypal carried out my complaint which involved a sale of a fake Michael Kors bag and me being a victim of fraud.

I have opened the dispute to get this resolved as I had paid about $100 on ebay and was delivered a fake bag. I was on a 2 month battle with the seller which never got resolved and got expired, then I tried to get it sorted through paypal who instructed me to return this bag. I received on the 26th May a email from paypal asking me to return the bag to the seller, but this was thursday before bank holiday! I then managed to send it on the 1st of June, on tuesday, straight after the bank holiday, and responded to a paypal email sent to me on that same date (01/06) with a picture of my proof of posting and tracking information, and a complaint that they didn't allow enough time to get this posted because they have disregarded it was bank holiday! On the 02/06 I get a email saying my case is closed and I haven't responded. I couldn't believe my own eyes!

I'm very inclined to get the police involved and call "action fraud" and will obviously also try to press charges against paypal for having allowed this to happen.

I have checked tracking information and the bag was delivered, so this seller is now laughing all the way to the bank getting away with aggravated fraud.

Now I was left without my money and merchandise PLUS out of pocket for the return postage! I contacted paypal who totally ignored my complaint. I'll surely not use paypal ever again. Can anyone help here?

Why did you carry on for 2 months with the seller?

 

At that stage you had plenty of time to get proof that the item was a fake (from a shop that sold the real thing OR trading standards or similar).

 

Then once you had opened a claim with paypal and provided proof the item was a fake, paypal would not have asked you to return it as its against the law to sell fakes.

 

Also if you had used paypal postage then they would have seen that you had generated a label ready for the returned item.

 

And could you not have posted it on the day you got the email or the Friday following or the Saturday morning?

 

Your only hope now is that if you funded your payment to the seller via a card then contact your card issuer and see if they can chargeback for you.

 

Personally if i get a fake item (only had x2) then i contact the seller and state that unless i get a full refund i will be reporting them to the police AND trading standards as it against the law to sell fake goods, each time i have got a refund that way.
