Dispute question (seller is not replying)

I bought an item on ebay and saw that item was removed by ebay. I cantacted seller and he told me that his account was compromised and that I should open a dispute. I opened dispute but he cant answer because because that was not his paypal account and  not his real e-mail address. Will I be refunded If I escalate this dispute to a PayPal claim? What should I do?

Since it was eBay, start with a dispute with eBay for the sale.

After that, more details about the issue are needed.

I asked Ebay about this situation and they told me that I should check with paypal because I already opened a dispute

If you have an official dispue opened on eBay, why not wait for that to proceed and close?  Have you provided strong supporrting evidence for that case?  Doesn't eBay have an official procedure for this?

There is no option to open an official eBay dispue because the listing was deleted. I have 2 options, to see paypal transaction and to click  "resolve a problem". But when I click  "resolve a problem" It only explains me how to open a dispute but there is not that kind of option just these 2. So I decided to open a paypal dispute and I  think that I will win the dispute because seller wont answer and also the listing was removed. Do you think that I am wrong?

Choose your PayPal displute claim very carefully as you only get one chance.

What is the real problem?  That the item was removed?  Does PayPal care about

Does PayPal care that the seller won't respond?

I think those claims are not relevant.

 

What should matter is that you have not received your item and you want PayPal to cover the refund.

As long as the seller doesn't provide any tracking information you should be OK as long as you complied with all of the PayPal requirements for buyer protection.

So now I should wait 2 days for sellers answer and escalate this dispute and after that they will ask me to explaine my issue or should I write another message via dispute? There is no tracking info because seller account was stolen. They put item on sale and after payment they marked it as shipped but it was never shipped.
