Scammed on Gumtree, How do I get a refund?

Agreed to pay £100 via PayPal for an iPhone 5s and I sent it directly to the email the seller told me to and the seller has not sent the item and will not respond to any emails I send him.
Rang PayPal up and they have said they have no way of getting me the money back as there is no Buyer Protection on these type of payments, is this true?

Depends how you sent it. Did you send it using the family /friends option, if so read this >>>
“Gift” or “personal” payments are intended as transfer of funds from family or friends to one another. For this reason, there is no processing fee when payment is made with bank or PayPal balance.
On the other hand, as it is a “personal” payment, there is also no Buyer protection as no goods or services should have been exchanged.
If he was not a close mate or family member why would you use that option, enabling the seller to evade his paypal fees and negating your buyer protection at the same time.
Your only hope is if you funded your paypal payment via a credit card then contact your card issuer and see if they will help you.
