PayPal automated software error

Last month, Sept. 6th to be exact. I had an auction item cancelled, this was to my understanding a done deal. The item stayed in Ebays "My Ebay", though when I would click on that item I would be informed that it had been cancelled, well enough of that...

 

On Oct 2nd, I decided to buy video card on Ebay, did pay pals easy checkout thing where you just click a button or two, well they decided to pay for a cancelled item (the item from last month).

 

I called Ebay first the evening this happend, it was in the evening, the person I spoke to said I need to call paypal. So I called paypal. I spoke with a person who didn't speak english as a frst language, she didn't understand my situation and I couldn't understand her when she spoke.

 

Well today I was perhaps a little angry, I called the paypal number again, this time I spoke with a person I could understand, but when I said the words "PayPal paid for a cancelled item" it was as if I didn't say anything at all.

 

The thing is now I am even angrier at paypal, it was an error of theirs to pay a seller for a non item. As far as I am aware the item is no longer available, it was last month after all. But now PayPal wants to file a claim against the seller for keeping the 174.70 that PayPal's pay for it later paid the seller for a non exsistent item.

 

Who the heck can I sue? I don't want the seller to be harmed over this, it wasn't their fault. I don't want to pay the money either.
