So long story short .. back in July of this year I purchased a cell phone from an ebay seller in China. The item arrived, it took a while (about 4 weeks). When I opened the package and tried to use the cell phone it would not work on our provider -- my husband who is a tech realized it was the wrong model and it was only made to work in USA (we are in Canada). The seller agreed to take the item back for refund or exchange and also agreed to return my shipping fees to my PayPal when the item returned back. No problem, sent the item back August 2. I chose Registered Airmail did not realize that option does not give you a tracking number. I sent the receipt picture to the buyer to prove I sent the item back.
12 weeks have now passed !! And the buyer claims they have not received the item back, they keep asking me to wait, wait, wait. So I gave them the benefit of the doubt, did not know that there was a 30 day ebay guarantee. When I got worried I started a dispute in ebay .. the seller keeps asking me to wait, keeps saying they did not get the tracking number I keep telling them I've sent a picture earlier, so again they ask me to wait. I contact Ebay they tell me to cancel the dispute as there is only a 30 day return policy and that I should contact PayPal as I had purchased with them .
So I start a dispute with PayPal, the seller for 18 days totally ignores my messages on PayPal, when I clue in that they are trying to make me go past the 20 day dispute limit now I am angry. Finally on day 18 they return a message and ask me to return the item. So I return a message saying how frustrated and upset I am .. so now ... I don't know what to do as I cannot find the receipt for sending it back to them. When I go to the message on ebay where I sent it to them when I click on the thumbnail to try to make it bigger.. it takes me to a Chinese Facebook ... so I log in .. it shows the messages but just a symbol where the picture should be .. so now... I have no proof that the phone has been sent back..
I am stuck, do I keep on .. and escalate the dispute? Will I even win it without a receipt .. or do I cancel.. and hope somehow the seller comes to his senses and sends me a refundor a phone... so very stressful this seller is so dishonest it makes me scream... WWYD????
