Hi, I received an email from PayPal with the following content that I have pasted below. It apparently references a fish lure that I was trying to sell and I guess because I used the term "curly tail grub" as part of the title my account has now been limited because of infringement of intellectual rights. I have already deleted this item from my eBay account and I feel it is a bit unfair since the term is quite a generic descriptive term for the item I was selling. In any case it appears the trademark holder is trying to sue me (along with many others I would assume) However, I need access to the funds in my PayPal account. Has anyone ever dealt with something similar and how was it resolved? This was a one off item I was trying to sell and I was just describing the item in my title. So, for me it is pretty ridiculous that I have received this email and my account has been limited. It seems if someone can sue you for this than it is possible to sue sellers for almost anything. Please see the details of the email below. We received a court order on October 19, 2020, affecting your access to your PayPal account due to possible infringement of intellectual properties of Curly Tail. Until further notice, your ability to send payments, receive payments, withdraw funds, or access the funds in your PayPal account has been limited. A judgment order may follow and require us to take further actions on the funds in your PayPal account. If you have any questions about this infringement action, it is important that you contact the plaintiff's representative outlined below to respond to this issue: Keener & Associates (email listed here) Court Order Details Court: U.S. District Court for the Northern District of Illinois Plaintiff: Curly Tail Court Case Number: 120CV05378; Case No. Trademark Holder Identified in Exhibit 1 v Does 1-636 et al If you have any questions, please contact us by clicking Help at the bottom of the PayPal homepage.
