am I out the money I gave the seller?  Emails to the seller are not being answered.   It's not a lot of money but still... I guess it is the principle.

No... you are still eligible for PayPal and eBay buyer protection.

how would I apply for this protection?  I considered the "report a problem" but this does not fall into either category that paypal presents as a "problem".

If you don't receive any shipment from the seller, you will need to open an INR (Item Not Received) dispute through either the PayPal Resolution Center or the eBay Resolution Center.

 

If you receive an item which doesn't match the item description, you will need to open a SNAD (Significantly Not As Described) dispute.

 

The dispute must be initiated no later than 45 days after payment was made.
