I am from the UK, and I paid £2000 recently to purchase a kitten from a French breeder. As it is my first time to purchase a kitten from abroad, I insist on paying by Paypal just in case something goes wrong. I even paid extra paypal fee to the seller for this.
The kitten was delivered to us later however within the first two weeks of his arrival, we found out he had a rare and fatal disease called FIP. Despite all our efforts to save him, he soon died
We spent way over £4000 on this kitten including vet bills. we ask the seller to refund us the £2000 and we will take the rest as our loss.
However the seller refused, at first she promised to give us a replacement kitten but later she decided to totally ignore us, do not answer our messages anymore.
I filed a Paypal dispute and explained all details, to my surprise, Paypal refused to refund us and close the case in favor of the seller, saying " the item wasn’t damaged, different or missing any parts as described by you"
I appeal with all the evidence including the chat history screenshots with the seller, I do not understand why paypal think it was not damaged , different, as I paid for a healthy kitten but I received one with a fatal disease then soon died, how different it can be?
I would appreciate if you could please give me some suggestion

Unfortunately that is the risk of purchasing internationally.
Did you fund your paypal payment via a credit card? If so you could try a chargeback as credit cards don't expect you to return items if the seller is at fault.

Item has to be significantly other than as described, however you bought a kitten and received a kitten, paypal does not get involved in 'qualities' of any item. Also you received the kitten presumably healthy and any issues did not show up until 2 weeks after delivery.
In the event of an item received but not as described the only way you get a refund 'if' paypal find in your favour is to return the 'item' back to the seller for a full refund, you can't send a dead cat in the post !!
Be careful buying internationally as if it was a UK breeder you may have been able to get satisfaction in the small claims court.

No, the kitten was sick from Day 1, however we do not know this rare disease, we found him did not eat much and sleep all day, and called the breeder who immediately told us it might have FIP, which was trigged by stress such as rehoming, later was confirmed by the vet.
So do I really have to dig the dead cat out then post it to the seller? I am so angry about this breeder now maybe I will do that if it is not for the sake of this poor kitten

As i said item has to be significantly other than as described, you bought a kitten and got a kitten.
Same as if you bought a bag and bought a bag but it was the wrong colour, neither would be covered.
Best put it down to a bad experience and buy a 'moggy' instead? Love moggies 😉

so the unethical breeder can get away so easily? she has done this before. Although I am possibly the first one paid her by paypal, she at first refused to accept paypal but I insisted and paid paypal fee myself

yes, I did pay it through Barclays credit card. I do not know their time limit though, as I have appeal with paypal regarding this a few months now

I have decided to post the dead kitten back to the seller, in his ashes. hopefully now paypal will refund me
