Unable to open a dispute

I have an issue with goods I received using pay in 3. The seller is refusing to answer my emails so I've tried to open a dispute but I just keep getting the message "we're sorry, you can't file a case on this type of transaction". Is this because I used pay in 3?

You have the same buyer protection whilst using pay in 3 so it would need to be another reason.....type of goods? etc
