Xingyao e-commerce Co., Limited - Scam company

Hi,

Like a lot of people on this forum, I have been the victim of the whole order then get a different cheaper item. I opened a dispute with the company because I never received the item. We went back and forth for 20 days and then paypal stated I had to escalate my claim or it would be closed. I did so. The item then came in the mail and was not even what I ordered. I let paypal know, and included pictures. Paypal stated I must return the item even though I was sent the wrong one. That would be fine except the cost to send this back to China is huge and currently the post office says they cant accept packages to China because of the virus. I feel the company should have to pay return postage since it was their mistake, or resend the correct item. Now that paypal has stated I must return the item, I can no longer write anything on my claim, only the return tracking number. My text messages to paypal go unanswered. This company from China is one of many doing this while bait and switch thing. But from what I can see, paypal does NOT protect the customer, and is actually encouraging companies to continue this fraudulent practice by letting their practices continue. I mean I was shocked how many people have left posts here and yet Paypal ignores what is happening. In a previous post, someone had given some links to places we can lodge a complaint. Maybe the FTC?  Can someone send me that link again please?  and any other place where I can lodge a complaint?

thanks

Hi,

I am in exactly the same situation.

Paypal not too interested to follow up.

Sent a $5 garden sprayer instead of a $30 Dolbin power sprayer.

Lots of promises all along. Sending back not an option so I will just have to accept the loss.

Ebay should ban all trade from this seller.

I also try to find UK/European sources for my purchases, but a lot of these companies are using UK sites as the source but after payment you realise you been conned to a far east company. This should also be look at by Ebay.

Lesson learnt.

@Billh1948 indeed, but as so many people have already fallen foul of this scamming seller (I am sure there are many others who have just taken the hit and not been on here to vent), they shouldn't still be able to use PayPal, they should of been blocked by PayPal months ago imop (and many other's opinion too). Therefore PayPal are definitely complicit in this fraudulent activity, they can spout the terms and conditions all they like but at the end of the day they aren't protecting us at all (imop anyway lol).

PayPal isn't doing anything in my case. I have been trying to move them into action since April or May.

They insist on the garbage-value item beeing shipped back to china (tracked) to a non existent address.

Main problem here nobody at PayPal is actually looking into it. PayPal just sends around prefab e-mails with standard procedures. (if they reply at all, i've been having absurd difficulty getting people to respond) They don't actually deliver any kind of tailored support at any stage in this disagreement. They don't care you're beeing ripped off.

There's an overwhelming amount of evidence against this seller, even just in this topic, the amount of claims this account has in Paypals systems behind the proverbial curtains must be astronomical.

Yet they do nothing.

I'm getting a creditcard and phasing out paypal completely.
Creditcard transactions are MUCH easier to dispute. Even if you continue to use Paypal with a creditcard.

Paypal's "buyer protection" is a hollow promise.

@Netherviking yeah nor mine, case been closed but I've still been complaining to them via chat and just last week an agent who I hadn't dealt with before actually gave me an email address to report the scammer. I did try adding it on here so that others could report it too but PayPal obviously didn't want me doing that for some strange reason as it wouldn't let me post it 😡. Anyway I did report it but whether it will actually make any difference is anybody's guess, I didn't get any sort of acknowledgement so who knows?

I am exactly in the same boat with that company. Ordered and paid for ($28 USD) a portable dog pool in April. It took 3 months for me to get the item and they sent the wrong product. Tired dealing with the seller but to no avail. Bumped it up to the Resolution Center where, after a lot of back and forth, the seller offered a full refund as long as the item was returned. The cheapest way to send it back would cost me $69 CDN. Tried telling PayPal that I should not have to pay shipping but they ruled in favour of the buyer « because I did not provide tracking information ». Tried telling PP that this was a scam but it fell on deaf ears. I posted comments on PP’s Facebook page and I will contact the police to report this fraudulent activity on the part of the seller and PP...

Not sure if this will work for everyone.  If you speak with the fraud department at PayPal, they should have a courtesy refund they can give people.  (I think that's what they call it).  They have 'X' amount of dollars they can issue to any customer.  So if nothing happens, you can ask for the courtesy refund of $30.00 or so to cover the cost of the item.

You can also use that courtesy refund to pay for shipping to return the item with tracking and insurance if you really want to go through with it.

It's not justice by any means towards this scam company, but at least you will not be out your money.

@terrynshed how do we get a hold of the fraud department? And that's a great idea. I am going to try to pursue that.
