Buyer didn't mark item as a 'return' - import duties are being charged. What to do?

A buyer bought an item he wants to return. I agreed to this and we ended up opening a case in Paypal. However, the buyer failed to mark the package as a 'return', thus meaning I am being asked to pay £90.90 (approx. $120) import duties to get it back into the UK. He won't pay this and neither will I. He suggested that he could send it again once he gets it back. The best thing would be for us to close this Paypal case and open a new one once he gets it back, but he is now saying he'll wait to see what Paypal decides and obviously realises he'll probably just get his money back anyway.
I have uploaded the message I got about the duties as additional information for our case, but am worried that I'll just be left having to pay these duties because he messed up. If I wait, the package might be sent back to him in addition to him getting his money back; if I pay, I imagine I have little chance of getting this money back.
What can I do?
