Can anyone tell me i received and item not as described and opened up a dispute, paypal has aked me to send it back with a tracking number adding more cost to my purchase, this will cost me another £10 to send back so i will be out of pocket, can i dispute this and ask for the return postage first or do i have to wait until after, dont really want to be out of pocket again as the seller clearly did not state the condition it was in as i never would have purchased it in the first place..

You cant get return postage money back .If its Heavy item try google see if you can find cheap couriers or ebay for them it must be singned delivery.
I have same problem as you but made 10 times worse by seller I bought item in UK the item was deliverd by the UK Royal Mail recorded service and now put in dispute they have given me a chinese address to return item to so he pays 75p recorded delivery to send to me and I pay 5.00 plus cost of postage going to today.

legally it depends on whether you purchased from a trader or private seller as rights change slightly.
http://whatconsumer.co.uk/buying-online/
it is the buyers obligation to keep the item for a reasonable length of time for collection
.
also EU LAW states the buyer should not be out of pocket, when buying from a trader.
however i have just raised this regarding my own refund with paypal and waiting a reply, whilst appreciate paypal may have their own rules it surely must still be inline with the law?

yeah thanks for the reply paypal should do something about returning items due to not being described, it went via dispute but paypal has asked me to send the item back with a tracking number before i get my refund but it says return postage and packaging is down to me, thats unfair , another £10 out of pocket, this was a private seller, i asked her to send me the return postage but she is not answering my mails, doubt i will get it back, sellers should be responsible for returned goods if the item is not accurately described...
