Im totally miffed by no refund from paypal!!

Hi all has anyone else had this before??
Basically my case is i was after 100x trees/ plants and looking on ebay i contact a seller ( with 100% feedback ) who was seller the trees i wanted but only in multipuls of 10-20 and i wanted 100 so i asked if he had 100x and he said yes he would send me a paypal payment request for the sum . OK i paid all ok ( this was over 30 days ago)
Problem is the delivery company lost most of them, So the seller and i nicley exchanged emails about getting this sorted.
Then he said he would be happy to refund me but paypal have frozen the payment HE said???
No i put a claim in to paypal for refund as its not my fault they got lost and im now down £265
Now paypal say
"
After careful consideration, we're unable to decide this claim in your favour at this time.
The item violates the PayPal Acceptable Use Policy. It's ineligible for PayPal Buyer Protection."
With no full explaintation as to why?????
I have been a full 100% business user of paypal for over 8 years and now this
PAYPAL IM very very disapointed in your reply to this you can see its not my fault yet im a victum it seems of your own systems. ( as if this was bought on ebay -- a linking company wiith your selfs ) i would have been covered.
Any one else have this problem??

When the seller sent you the invoice for payment i wonder if he sent it as a gift payment request and not a purchase cus if so then it would be ineligable for buyer protection.
Can you go and find the transaction and click on the details and see if it states what kind of payment it was.
If you can't get it back via paypal then if the seller is a business t hen under distance selling laws they have to refund you or you can take them to the small claims court.

OK just re-read your post and think i realise where you lost your protection.
You bought from an ebay seller but did not go via ebay so you lost your buyer protection.
What your seller should have done is relist the auction with the amount of trees you wanted so you could bid.
Whilst paypal does protection for purchases, if you are buying from an ebay seller then for buyer protection you have to go via ebay.

I paid a deposit to go and look at a caravan, the guy obviously did not advertise it properly as there was so many things wrong with it. The main thing being the lights/indicators did not work and you could not get the lens off to fix them. The tyre was half flat and there was nowhere to get air. How on earth could I tow this caravan for 5 hours to home like this without causing an accident or getting stopped by the police. When I spoke to this guy he advised me everything was working and all I had to do was hook up and go. I paid the deposit and he took the item off before I was able to complete the offer through PayPal. PayPal have ruled in his favour. Just goes to show you are better off paying by credit card at least you get the chance to get your money back. This guy was selling a caravan that he had not described properly on ebay and on the phone but he gets to keep my deposit. Angry is not the word!!!!

Thats because there is no buyer protection for motor vehicles.
There is also no buyer protection if you pay in instalments.
You need to read up the short section on buyer protection before you start buying so you know you are covered.

I didn't realise a caravan is included as a motor vehicle. Have read this guys feedback which says 100% but if you dig further he tried to sell another caravan which was not as described. Just feel that they should have least contacted him and told him he had to change the description but they didn't, they allowed him to advertise exactly the same caravan with exactly the same description. Just hope nobody else falls into his trap.

Just a thought, if you funded your paypal payment with a card then contact your card issuer and see if they will chargeback for you.

Thank you, the only problem is the card set up is a Debit Card. I am angry about losing the deposit but even more angry that Ebay never stopped him from advertising the same van with the same description even though in our resolution case we had listed everything that was wrong with caravan that was not listed and more important the lights didn't work and you couldn't get the lenses off because the screws just went round and round. The tyre was half flat and nowhere to get any air only driving 7 miles to the nearest garage. This caravan was un-towable and we had a long journey home, it would have been very dangerous to tow it.

Debit cards can still chargeback but its done as a "goodwill gesture", but if your bank thinks you may remove your business you may find they will help you.
