Hi, I am going to buy some amber jewelry from a seller I found from Facebook. Actually, at the beginning, he refused to using PayPal, he said he had bad experience when selling goods via PayPal and he is not using PayPal anymore. But finally he agreed using PayPal after I showed him my 100% positive feedback on eBay. But my question is, he didn't use PayPal for months, so I think there would be no funds on his PayPal account. If I didn receive my items after payment, and he has already cashed out my payment, can I still covered by buyer's protection of PayPal? Most importantly, could I get my money back if there is no funds at all on the buyer's account? Thanks a lot.

The whole point of buyer protection is that if you file a claim for non receipt and paypal find in your favour, then if the seller does not have any funds in their paypal account (or refuses to refund) paypal will refund you under their buyer protection programme.

Then they put the sellers account in negative and limit it until he pays them back again.

However it is more complicated if the item arrives misdescribed as you may well have to send the item back at your own expense before getting a refund of only the original payment and not return costs.

Best you read up on buyer protection before buying privately.

Also just a small point, you do know that BUYERS can't get neg feedback on ebay don't you? They can only get nothing or pos feedback. Its only sellers that can receive negs.

If the items shipped are not matching the sellers description, or they send me fake items. Can I also get refund directly from PayPal even if there is no funds at all at the buyers' account? P.s. Will I get the refunds directly from PayPal or waiting for PayPal get money back from the seller if there is no funds at all in the seller's account?

Sorry, not so clear, you mean if I return the misdescribed items back to the seller, I will get money directly from PayPal no matter there is funds or not in the seller's account. Did I get it right? And if they send me fake goods, I have the right not to return the them. Thank you for your patient.
