Protection for sale of goods from non-merchant

If an individual with a personal account lists an item (personal) for sale (non-merchant individual) on a classified site and I pay with PP through the Gods/Services option, Does that qualify for buyer protection if the other criteria for protection are met? ie, if they never send the item or its fraud,.. Am i covered since the seller is not a 'merchant'?
