Open a dispute after 45 days of payment?

I placed my order on June 5 and went on a vacation, to a place without...eh internet. So When I got back and check my  order status, it still didnt shipped yet. So I immediately sent them an email on June 17. Not until June 19 that I got an email saying that my order has been shipped through USPS First Class Mail International Parcel but they did not provide any tracking number. Also note that the payment was processed immediately on June 5.

I tried to contact the seller but got no responses so far. 

So I decided to open a dispute and here we go, 45 days limitation.

 

Is there anyway to get around with it?

I have the same problem but I do believe I am partly to blame for not being more decisive about what to do.

 

I won a 14CT Gold pocket watch from a US onine auction and I paid $442 with PayPal. The item was not without dents although I was told it was. The auction house had been dishonest from the beginning in description of  the watch before I won the item but I realised that the type of measurement of case size was right but measuring a case with the crown is not the normal procedure with a pocket watch because normally one uses just diameter of the watch case for sizing a watch. I did however pay for the item to avoid none payment of an auction lot won claim which would give me a bad reputation with auction houses if I wanted to bid in another auction at some time

 

However the description of the watch without dents was wrong and I received the watch 3 weeks later after I had paid for the item and there were many small dents wthin the case of the watch. The time I received the watch was during the holiday period of December 2013 so not much do do about seeing if the watch could be fixed. I fianlly found a case repairer to get most of the dents out but the movement needed a lot of work too. I recived a full assessment last week of everything concerning cost  and I decided to see if it was over 45 days and yes it has been 53 days since I paid for the item. 

 

I realise I should not have tried to get the dents out but I should have put a claim in immediatey aftr receiving the watch. I had wriiten to the auction house complaining as soon as I received the watch about a dishonest description but got no reply.

 

I will add there were photos of the watch on the aution site but they were taken at such an angle that it was impossible to detect any dents  on the gold case

 

I have lost about $180 on the watch but my advice after my own experience is to act quickly and put in a claim as soon as you can.

It took long enough but paypal is finally increasing dispute time from 45 days to 180 days. This change will take place in Nov. 2014. It seems timed to meet alibaba's increased visibility in the US market. Shipments from china via sea transport are 35 days and with lead time often 30 to 60 days it is not uncommon to receive shipment after 90 days.

So are you saying that I can open my instantly closed dispute in November? I'm seriously thinking about leaving PP because of this ridiculous time frame.

As an aside, I would do a google (especially at SiteJabber) regarding Alibaba or AliExpress.

I'm so sorry but if you can't figure out you've got a problem within 44 days, you have got to get your priorities straight and become more organized before buying online again. It's quite simple actually. After your purchase, go to your calendar and count forward 44 days. If you don't recieve the item then, open a paypal claim it's that simple.

Good idea and wise advice. Get the claim in place! I ordered a digital clock for my desk and it shipped on Aug 26. It's now 37 days and I've opened my file.

Really? That simple? I beg to disagree.

 

My priorities are just fine thank you. What isnt fine is the 45 day limit.

 

Anybody who orders ouside of North America knows it can take more than 45 days.

 

I order from China/Asia all the time. It sometimes takes way more than that due to unforseen circumstances. But tracking numbers don't always give an accurate picture. At present I received an item in July that I ordered in May. To this day, the tracking number says it is stuck in Mississuaga even though I am looking at it right now.

On the other hand, having good communication with the Seller can waylay the need to place a claim. But thats in an ideal situation. 45 is too short a time for International shipping, plain and simple.

 

So how is putting a little star on day 44 really helpful after all when PP's reality is false?

Thanks daddy dreamwolf. Now that you've told me that I need to get my priorities straight and taught me HOW to count to 45 I feel so much more organized!. The only problem is that sometimes my items don't arrive within the 45 day window, so what should I do daddy? Please help daddy!  😜

I've fallen into the same trap. I buy a lot online all thru Paypal for the 'security' - I thought.

Nothing has ever taken "45 days or more" to arrive in Toronto from China. Now I get it - because of that 45 day limit for filing a dispute if a seller either takes too long, ships crap or dooesn't ship at all, the buyer is s**t out of luck. Maybe Paypal should be a bit more discriminating. They know how long it takes to get from A to B. A Seller who is using this '45 days or more' statement shouldn't be allowed to deal with Paypal. It's obvious what they're doing. Paypal is turning a blind eye.
