Scammed & PayPal will not help!

Recently I sold my iphone via paypal.

 

The buyer paid via paypal and the money hit my account, I withdrew the funds to my bank and sent the phone no problems.... However....

 

 

Today I find out that the 'buyer' has requested a refund because they did not buy the phone, thier account has been hacked by a 3rd party who paid for the phone with their account, provided me with the 3rd party address which I shipped the phone to. So the person whos account it is was £435 down until they realised and reported this. Paypal opened and closed the case within 23 minutes and issued them a refund.

 

Now I am down a phone and £435 and Paypal have just told me to contact the Police. ( I have reported this to the Police )

 

This is theft and fraud and Paypal will not help me!

 

 

Can anyone offere any suggestions?

 

I refuse to pay the negative balace on my account. what will happen?

They posted the phone and then had a chargeback, so their paypal account is in negative which they will have to pay back so in effect they have lost both unfortunately.

Like I've said eventually when I talk to PayPal I will just ask for a court date and take it from there. Scammers must be shamed

before you decide to accpet payment via Paypal,you should learn how it works and what kind of protection does it offer the buyer and the seller?

 No,you can only lose the phone or the money ,not both.

The phone is hers to lose,the money is not hers.

she lost the phone,and the money goes back to the person who owns the Paypal account.

She lost on shipping.

so in total,she lost the phone,shipping fee and whatever fees she cannot recovered from the venue provider,insurance .

her paypal account would not be negative,if she keeps the payment in the account instead of transferring it to her bank.

(the money is not hers to keep since the owner account was hacked)

Her paypal account is already in the negative so to clear it she would have to transfer funds to her paypal account balance.

Not sure how you are going to get someone in Lithuania into your court system, afraid US law does not apply internationally.

Firstly I am not a 'her' I am a man.... Secondly I am not in the US. Thirdly paypal's investigation team should surely look into this. The phone has been sent to an address so they will know where the hacker lives....

Firstly that does not really matter, no one can know on here unless you use a gender specific name.

 

Secondly if you post on the US forum and don't say you are in another country then not only does it affect the advice given as paypal is different country to country but it is also a waste of time us answering you.

 

If and only if you are in the same country as the hacker then yes you may have a chance of court action if you do so yourself.

But if they just state that they did not receive the item and you have no TRACKABLE proof that they did then the odds of you winning are a tad remote.
