Returning an item that was broken

I bought an item for the amount of 127.50 and it was damaged, initially he had a no return policy but I contacted the seller and told him that the item was not working and he told me I can return it and when he receives it I will get my money refunded. How do I ensure that he pay me back in full and make sure that I don't get cheated out of my money?

Return the item using online tracking (e.g. USPS Delivery Confirmation). If the seller fails to refund after the tracking shows the return shipment was received, open a SNAD (Significantly Not As Described) dispute through PayPal's or eBay's Resolution Center.
The PayPal/eBay dispute must be filed no later than 45 days after the payment was completed and must be escalated to a claim no more than 20 days later... don't let those deadlines expire.
