GOT CHEATED BY A SELLER,PAYPAL NO HELP

I RECENTLY PURCHASED 2 BRAND NEW  STILL IN BOX SLICE CARTRIDGES ON A SECOND CHANCE FROM AN EBAY SELLER. I WAS THE HIGHEST BIDDER. I HAD NEVER DONE THIS BEFORE AND NEVER WILL AGAIN.!!!! SHE MAILED THE ENVELOPE FROM CALIFORNIA TO WV FOR 2.92 AND SOMEHOW IT MADE IT IN A DAY AND A HALF, CLEAR ACROSS THE US IN A DAY AND A HALF. ANYWAY, WHEN I REC THE ENVELOPE IT WAS OF COURSE EMPTY! I CONTACTED HER SEVERAL TIMES AND SHE CONTINUOSLY CHANGES HER STORY. FIRST IT WAS MAILED IN A BUBBLE WRAPPED MAILER WITH ,PRIORITY SHIPPING AND  WITH DELIVERY CONFIRMATION. NONE OF THIS IS TRUE.IT WAS MAILED IN A PHOTO DOC. HOLDER, NO BUBBLE WRAP AND NO DEL. CON.!!! I FILED WITH PAY PAL AND NOW REC AN EMAIL STATING THEY WONT HELP ME.  I HAVE THE MAILER. I HAD IT WEIGHED W/ AND W/OUT CARTRIDGES AND I CAN PROVE SHES LYING BUT I CANT SPEAK TO AN ACTUAL PAY PAL PERSON! AND WHEN I TRY AND SEND AN EMAIL IT TIMES OUT AS I STINK AT TYPING.. WHAT CAN I DO? AM I JUST OUT MY MONEY? MAYBE I SHOULD JUST CLOSE MY PAY PAL ACCOUNT?

I too am figting something simular. I have a nut who I have found out scams people all the time and heres the kicker, he even send life threating emails to people and so far to date he has not been kicked off ebay. On a positive note the police are monitoring him, internet fraud and of course the life threating issue plus some other laws they broke or at least thats what I'm told. Go outside ebay if they won't do anything, Antything that crosses state lines is a federal offense. I'll bet your not the first or last.  Copy all the information you have on it, show to the cops, you will be surprised on what they are able to do. Internet fraud is a multi-billion dollar industry. Kinda makes you understand why so many people are stopping doing this, no support to the honest people like us, sad really.

304GIRL Was this a legit ebay purchase, does it show as a win in you my-ebay page.

 

If it was and the seller didn't have D/C and you filed an INR paypal claim, you should have wone the claim.

 

If it was an off ebay purchase and you filed an SNAD claim (which it was since you got the envelope), there is no SNAD buyer protection for non ebay purchases.

Also - if there was delivery confirmation and you filed INR then yes the seller would win as it did show delivery. In the case that the mailer is empty with DC then you would need to file SNAD to win

Thanks to all who gave sound, strong advice to me on my issue. I received a response to my issue and I'll have to say they also agreed (eBay) with me or you in this case. The delivery confirmation sealed the deal. The fact the buyer moved and never reported it to me was not a sellers fault, nor was it the sellers fault they did not track order and did not fill out change of address to have mail forwarded to them. eBay agreed 100% with me thank god. Unfortunately I found out this person scams people all the time (thru other eBay's told me). They blackmail sellers into giving them refunds or they won't change nasty rating. Sad to hear about the buyer who got ripped off from a seller, keep fighting it. I'll all but bet you will win and they will get caught so to speak. The persistence of your actions will determine the outcome, mine did.

Again, in your case, an empty envelope sent, I want to tack this one, I have never heard of that but do know, no response from seller indicates GUILT in eBay's eyes from what I have learned. The seller knows what they did and basically hope you simply go away. I wish there was a site for all of us who get scammed by these bad ebayers could go to and tell each other who they are to say others from dealing with them as well, that would stop them if only for a time. I don't think this is the site to do that. Schemers always find a way to get gain because they have no morals or anything of true human value or so it seems. Best wishes to any who get scammed, fight it or else those schemers win. Somehow the word does get out and eventually no one trust them. I now have a new understanding that a great seller or buyer can have one bad CSR and it truely may be someone scamming them, no real fault of their own. If 99 say they are good and one does not, you would think no matter who or what that one is someone no one can please. Thanks to those who care and listen.

My husband just got scammed by a person that keeps listing the items on ebay then contacts potentiall buyers and makes the deal outside of ebay.  The deal my husband made was for cameras and video equipment for $1800. His biggest mistake was agreeing to complete the sale outside of ebay and paying with a certified check instead of using paypal.  When the package arrived it contained packages of seeds and a small figurine...certainly not what he paid $1800 for!

First, I chewed him out for the deal. Sure, it sounded good at the time but now the same seller has relisted the same items (and stopped the ebay listing before it ended WITH BIDS) 3 times since they received his payment.  Second, I told him this is not only INTERNET FRAUD but also MAIL FRAUD which is a FEDERAL OFFENSE.  He got the most help from the US POSTAL SERVICE.  He still hasnt got his money back yet but the bank that received the certified check has placed an account freeze on the sellers bank account. The local police are involved as well as the Post Office.  Crossing our fingers and hoping he gets his money back but meanwhile just want to WARN OTHERS!
