Refund/echange for item not true to description?

Hi I purchased a mobile phone on ebay,it was April last year, anyway yesterday the phone grew a fault and after talking to the manufacturer they advised me to take it to one of their support centres, I did this and was told that phone which was sold and advertised as new was in fact 4 years old and was out of warranty, I contacted the seller who admitted knowing it was 2014 model and that if I returned it they would try and repair it, I told them that I thought this was unacceptable and asked for either a refund or a new phone to which they refused flatly and insisted i send the phone back for a repair.
I contacted ebay and they don't seem to want to do anything about even though I feel it was miss selling of an item, the phone turned up in all the correct packaging and bits and bobs you'd expect to get with a new purchase and looked every bit a brand new item.
Is there anything I can do to try resolve this issue as ebay don't seem to want to help.

You only have up to 180 days to open a paypal dispute, after that its between you and the seller and ? small claims court?
Advice is voluntary.

Alas the seller is from China so most of the options such as trade descriptions and CAB won't hold any clout, although if I should use ebay again which may well not happen again I will make sure the are UK sellers.
