Broken item query

Apologies for the vague title but I'm trying on here before i debate calling the dispute team when thye're open tmrw.

 

Long story short, I bought an electronic item using paypal from a UK based website back in May. 

The item broke , not through misuse but down to poor quality and a known, well documented fault with this particular item (a battery for an e cigerette) 

and after speaking to the store in person they basically said "tough luck" and then moved on to ignoring my calls, letters and emails. 

 

Before i head down this path i'd love to know if theres any chance of a positive outcome with ebay or am i better going down the comsumer right/small claims court route? 

 

I know it's well outside the 30 day refund period and paypals usual period of claims but the item is has not functioned for a reasonable period of time or what ever the actual terminology is to that effect. 

 

(id have asked on here way sooner but i for some reason thought i'd paid with my debit card rather than paypal) 

 

If i can provide any more info then please give me a shout and i will do asap.

Ebay and Paypal are 2 separate companies with 2 separate policies for buyer protection.

Whilst you are probably out of time for an Ebay dispute you are NOT out of time for a Paypal one as you have up to 180 days with Paypal.

So go and file for 'item received but not as described' via the 'resolve a problem in the resolution centre' link lower left of your Paypal summary page OR click on the transaction and use the link on the details page.

Put in ALL the facts and then escalate to a CLAIM. You may have to return the item back to the seller trackable to prove delivery at your own expense UNLESS you activated the below link before you made the transaction BUT wait until Paypal tell you to do so first.
