Faulty Ebay item

Hi,

 

Just wondered if anyone could help me...

 

I bought 2 items in 1 sale from Ebay (UK seller and UK items) and one of the items has developed a fault. I bought the item on 19th Dec 2015. I emailed the seller 3 times via Ebay without response so contacted Ebay and they basically said contact the seller via phone. I contacted the seller and he basically said the NEW item only carried a 90 day warranty and rather rudely, hung up the phone I couldnt find 90 days on the items page so assumed? it carried a 12 months warranty.

 

How do I go about resolving this?
