Counterfeit software on tablet computer

Can someone help me please.
I've read the forums and can't find specific information.
I recently bought a tablet that boasted having android programming and android market from ebay using paypal. When it arrived it looked fine, over the next few days i noticed problems, apps did not work, google android market was strange and didn't work.
First thing i did was email the seller, no reply.
I researched until my heart was content and found that Google only allow certain makes and models to have Google Android Market as they need to pass Google testing to have their product.
The tablet i bought isn't on the list, meaning that the software is either counterfiet or put on the tablet illegally and therefore isn't compatible with the tablet so doesn't work.
The tablet also didn't come with the real instruction manual plus ran extremely slow (compared to the same tablet someone i know owns.)
I would like to open an ebay/paypal case as the software is so counterfeit that it makes the product barely usable. I e-mailed the seller again asking if he has anything to say about this and he's yet again ignored my message.
When i open a paypal claim, i've read you have to have written proof that the item is counterfeit. Would i be able to file a case and use the references from the google website (including links to the website where information that the tablet is not on the verified to be allowed Android Market list, making it against Google's T&C's
or would i have to find a computer expert to also verify this? as i have no idea where i would find one and what they are meant to say other than them checking the google list themselves?
Any help would be much appreciated as i'm trying to give the seller 3 more days to respond incase this is a genuine accident.

We would need a written document from a third party.
Even a shop that supplies these items may be able to give you this. Without written confirmation we wouldn't be able to process a claim.
