i purchased tickets to kentucky derby and 1 of 3 was confiscated at gate as being stolen. now i am stuck with the bill even though churchill downs confirmed they confiscated ticket.

When you make an off ebay purchase, you are only covered for non-delivery of the item.
Your situation is that the item was delivered, but it wasn't a valid ticket - that's called SNAD and Paypal does not cover it in this case.
If you used a credit card to pay for the item, file a hargeback by calling the customer service number on the back of the card.
