Buyer Fraud and Paypal Dispute / Claim Resolution

Here is the summary of my situation. I sold a G2 cell phone to user uany9048, a buyer (485.00) who later claimed INR and didn't receive the phone. I am a new seller and made a mistake by only getting delivery confirmation (not SC). The buyer later made a claim to get his money back.

The facts:

-The confirmation shows delivered.

-I called the post office and it was picked up in the post office itself (it was computer scanned for the confirm) and the person had to show ID. We know the buyer received the item.

-The buyer purchased the exact same device from another new seller the next day after purchasing mine. Hers was delivered at the address the day before. She also did not use SC and also received a claim against her from this buyer. This buyer is scouring the waters for new sellers like myself who miss a policy that's only obvious after a problem arises (sure I should have done more research, and I am not one to usually make excuses, but the info is not proactively given to you). I'm guessing that if the seller actually uses SC he will either keep the item or have the option to return it within the return period listed and try again later.

-The paypal claim is in the decision process right now. It gives a date of Nov. 27 of decision or request for more docs. The buyer gave a quick deceitful summation, I responded with tracking, a short message about the picking up at the post office, and a longer email detailing every part of the situation sent to the complaint email address to be added to the file.

-The buyer has private feedback.

- I have filed a police report with the local police. I received a case number which I added to my long email sent to be added to the file on the case. The officer said that right now to give the case number but currently it's not actually theft because paypal is still holding the funds.

- I filed a complaint of mail fraud with the Office of the Inspector General.

- I have sent an ebay message to the buyer letting him know what I am doing in regards especially in regards to the last two facts I just gave.

- I have been in contact with the other seller who was defrauded (or likely defrauded). She called the post office and couldn't get any more details on the delivery. She has filed a police report and is also looking to file with the Inspector General.

- I know I'm standing against a huge policy, despite the obvious evidence (how are these things decided? Is it similar to US Bank and foreclosures?).

- I'm guessing if I do get it resolved in my favor the buyer will then change the dispute to a SNAD. How does getting SC even help in that case? I will get a box of literal dung back and I am in a no win situation.

-The person filed a SNAD against a seller some months ago (searchable on google), but it's unclear if that was legitimate or fradululent.

- I have put in the person's name in google and such looking for a criminal history or something like that, with no such luck.

- I have called paypal about three times. First, to assert that this was fraudulent and told of another seller. They didn't seem too concerned with the name, just that if this person had a "habit" of doing this, they would look into it. They said they would mark it as such and it would be reviewed and investigated. And also follow the normal process of resolution. Second, to ask if when I provided a response via the claim portal on paypal's website if I would be able to give additional information later before a decision is made. They gave me the email address. I called a third time to get the email address again.

-The other seller has called paypal and was told they were going to rule in the buyer's favor due to lack of SC. She was told something similar in regards to the fact if a buyer had a history of this. It would get flagged eventually but is a long process of recognition.

- I know someone who works at the post office and I am going to call them personally and see if it's possible to get some sort of documentation that the item was picked up at the post office. And then fax that to paypal.

- The people in the forum and the other thread have been extremely helpful.

I just wanted to provide this to a greater audience with a better subject heading because I'm looking for HELP!

There's a lot of experts out there and good people. I really appreciate you taking the time to read this and respond with assistance.

Thank you for the warning and the buyer ID to BBL. Unfortunately, sometimes we learn expensive lessons for our lack of attention to policies.

 

Regarding your concern about the buyer filing SNAD if he loses the INR case, I don't believe that can happen. As I understand, a buyer can only file one case. And in this instance, even if allowed to file SNAD, that would prove the buyer to be a liar since there's no way an item can be SNAD if (as he'd claimed)  it hadn't been received.

 

I hope the other seller is as diligent as you are in obtaining statements from the post office that can help prove the buyer to be a scammer.

I wish you all the luck. I have sold 1 item on here and will NEVER sell again, only buy. I sold a dell mini computer, and insured it. The sell price was around $185.00, the buyer paid for it and I shipped it. Again I insured this item, the postal lady helped me package it as it was a dell mini laptop and we had to be sure it was secure, it was packaged in a priority box. After the guy got the box he filed a  item not as described claim, stating he recieved an empty box.. I wasnt required to have sc, but I had insurance on it and a tracking number. So the post office wrote a statement, that they indeed helped me package the computer, all of their contact info and such, the date it was shipped and a copy of the insurance slip was all faxed to paypal. Well this dude won. I appealed it, I then filed a report through the USPS, they investigated gave me a report that stated it was shipped scanned, no tampering and HAND DELIVERED! I got a police report even, and the cop wrote a note on my behalf., because he spoke to the postmaster who conducted the investigation. The cop tried to call this guy numerous times and he would not call him back. Again he won! I could not get my insurance money because all scans went through, box was not empty or damaged and it was HAND DELIVERED and SIGNED FOR and HE DID NOT TAKE THE BOX TO THE POST OFFICE OR EVEN COMPLAIN AT ALL WITH THEM. You see USPS had signature from him but couldnt give it to paypal without a subpeona because of his privacy rights. But since it was insured they got a signature in case of any problems. After faxing all this info and proof to paypal, he won. Paypal told me that he won because he somehow got a police report stating it was empty, but would not require him to go to the post office. I emailed him about the box and he wouldnt respond. The police here tried calling him again no response. Anyone can open their mail take the items out and then go to the police station and say i recieved this empty box and need a report for paypal dispute. After all the proof I had, he still won. I am now going to the Attorney General I feel like this isnt fair to the honest people, I will never sell again that is for sure! :)....Sorry for jumping all over the place lol, when I get worked up, I just yammer on 🙂 Good luck to you.

As you can see buyers have more protection that sellers 🙂
