Seller requesting me to close my dispute.

I have a disputed transaction because of an item that was NOT as described.

Today the seller sent me this:

"But now, we want to refund you to solve this issue ASAP, and PayPal does not let us do so by freezing the transaction amount. How about you withdraw the case, then we'll arrange a refund for you again."

is this real? can they not reimburse me while the case is open?
the case still says they have not responded to the case.

If you had to close a case to get a refund then it would be pointless opening one.
NEVER close a dispute / claim until you have a refund.
If the seller issued a refund then that would close the dispute automatically.
If he doesn't escalate to a claim.
Do not close it or he can ignore you and you can't open a second dispute OR re-open a closed one.
