I have recently been scammed on Depop, I bought a phone for £200 and the seller now messaged me saying, that they have already spent the money and I am stupid. I was wondering if I can still get a refund if the seller says they have already spent the money

Yes, doesn't matter if the seller doesn't refund you as if you win a dispute for non receipt of item then paypal will refund you under their buyer protection guarantee.

That is as long as you did NOT use the family / friends option to pay?
