If I accept replacement item does that negate my rights to return if not authentic?

My daughter purchased airpods and the box arrived empty. Seller says he accidentally sent wrong box and will send the new airpods and refund some $$ for the inconvenience. If these don't end up being authentic or this isn't legitimate are her rights negated if she agrees to this deal?
