Dealing with dispute as a buyer

I have opened a dispute with a seller and the seller offers to fully refund me after he has received the item. Without escalating this to a claim, I have 20 days before the case closed automatically. Due to shipping constraints, the shipping itself may take more than 20 days. Should i escalate this to a claim so that the case will not automatically closed after 20 days if the item has not reached the seller.
