Cannot return comcast modem in a dispute resolution

I purchased a comcast cable modem online from the seller. After activating it, I went to the service center and returned the old modem.
I was told that the new modem I had just installed was stolen (comcast never sells its modems!) and that it belonged to comcast. Since I activated it, it is now associated with my account and would henceforth incur rental charges each month.
I had bought the modem to own specifically to avoid the monthly rental fees.
I initiated a dispute (merchandise not as described) and the seller agreed to take the modem back and issue a refund.
But I can't return the modem to the "seller" since it doesn't really belong to them, it belongs to comcast. If I were to return it to the seller I will be on the hook for it with comcast.
I would like a refund of my purchase price. But I can't return the merchandise.
