What if? (Lost in post questions)

I've been trying to read up on seller / buyer protection on both eBay and PayPal. To be honst it is tiring trying to open the respective pages.

 

My questions are pertanant to both I think?

1) If I state in my eBay advert that I will not be held responsible for items lost in the post if the buyer does not opt to pay for insurance - How do I stand legally?

 

2) If the buyer pays via PayPal with the funds coming from a credit card, then if the item doesn't make it, surely they will be able to claim from the credit card. If they choose not to claim from their credit card and claim from me, do I have a claim on their credit card, or can I force them to claim from their credit card provider?

 

Seems to me that as an occasional seller,  the buyer has the most protection. 

Tough questions I know. Any help  / guidance appreciated.

Hi pikeman2210, 

 

Firstly, If a buyer pays for an item using PayPal, PayPal will go by its own terms and conditions even if you have put on your listing that you will not be held responsible for items lost in the post. As a seller we advise that you ship your items tracked and signed for (all items over £150.00GBP should be signed for to be covered) even if your buyer does not choose this option. This helps offer you with Seller Protection and covers you in the event the payment is unauthorised. The tracking information will also cover you as it will confirm that your buyer has received their item. 

 

If your buyer pays using their credit card then they are entitled to file a chargeback with their card issuer if they do not receive their item or the item is significantly not as described. They can also file for an unauthorised chargeback. In this situation we will ask you again for the tracking information, showing delivery to your buyers address so we can cover you under our Seller Protection policy.
