Hi there,

I have bought some items that were advertised on facebook, I was unsure wether to buy them at first as i was worried about payment and that, but i was reasured that i could pay via paypal so i read the terms and conditions on buyer protection again and again. The total cost come up to £203.99.

When i paid him on paypal i paid him via the 'send money' tab and clicked for the purchase of 'goods'

When the seller told me they had been posted i asked for a tracking number and he just kept replying 'ok i will get it for you know' i asked him for it about 5 times over a course of days and then he dissapeared, i cant get intouch with him or notihing. It has now been nearly a week since i bought them and iv had nothing in the post at all, and i paid for first class postage so should have been here start of the week.

I opened a dispute but was forced to esculate it to a claim as the seller could not respond or something?

Will this effect my case, and am i likely to get my money back?

I have read that paypal can only get your money back if it is in the scammers account and they are awear of this so they take it out.

I feel so stupid!

The seller has blocked me so i cant right reveiws or contact them. what can i do? Other people are going to fall victim to this, is there not anyway we can stop them?

Thanks any help will be apprechiated!

In the past, the PayPal Buyer Complaint Policy covered non-eBay items, and would only refund from money in the seller's account. That policy is now defunct, and PayPal Buyer Protection has been extended to cover non-eBay goods. So, if you win your claim, PayPal will re-imburse the full amount that you paid.

There's a lot of out of date information about PayPal on the Internet. The only thing that you need to read (and comply with) to help win your claim, is section 13 of the current  PayPal User Agreement.

Section 13.3 of the User Agreement, lists payments that are not eligible for PayPal Buyer Protection. If your purchase isn't eligible, but you funded the PayPal payment with a credit card or VISA debit card, then your card provider may be able to recover your money using the chargeback process. Please see:

http://www.telegraph.co.uk/expat/4201389/Play-your-cards-with-care-in-online-dealings.html

NB Do not initiate a chargeback while the PayPal case is still running, as it will cancel your PayPal case.

Thanks, i will look into that if paypal dont refund the money.

As for the terms and conditions in section 13, i read these before i made any payment and made sure that i followed it exacly to them so if anything did go wrong i was covered.

Hi SUHAILA,

If I've read your post correctly, you paid for the boots directly with a PayPal credit card (instead of the PayPal 'Send Money' service). As I've never had a PayPal credit card, I'm not familiar with the procedure for disputing a transaction. Is it not explained in the terms and conditions document that would have been supplied with the credit card?

Anyway, I presume that you tried the following:

  • Signed-in to PayPal and clicked Resolution Centre (Under the My Account tab)
  • Clicked the Dispute a Transaction button
  • Selected "Item dispute: I did not receive an item I purchased or the item I received is significantly not as described" and clicked the Continue button
  • Clicked the Find transaction ID button (next to the Enter transaction ID text box)
  • Looked for the transaction for your boots in the history window that popped up, but were unable to find it - hence couldn't click the Transaction ID number.

If that is the case, then you will require assistance from PayPal Customer Services to open your dispute.

I've never had a problem getting past PayPal's automated system, to speak to a representative. This is all that was necessary:

  • Obtain PayPal's telephone number and a Secure Web PIN by clicking the CONTACT US button on the PayPal home page, followed by Call Us and then the Call PayPal Customer Service link
  • Dial the number given and enter the PIN when prompted
  • Follow the menus using the telephone keypad or say 'Agent' when prompted for a verbal input

Alternatively, you might try something that works with many other automated systems: Simply do not respond to any prompts (apart from entering your PIN) - just wait for the message "Please hold while we connect you to a representative" (or words to that effect).

Good luck.
