Buyer Received Item & Payment Refund

I sold a gold coin on eBay and mailed it with insurance. Buyer received it and claimed that it was a piece chocolate. Buyer wanted refund before returning item. Buyer opened "Item doesn't match the description" case. Buyer admitted to receiving item but claimed it was a piece of chocolate. eBay closed case as "The buyer claimed that they received an empty box." even though buyer never claimed that (buyer claimed item not as described). eBay refunded buyer's payment. eBay declined my appeal. What can I do after that to get the payment for my coin back. Can I open a case with PayPal?

Seller sent me a gold-foiled piece of chocolate..NOT a real coin.  I paid $1660 for this item and feel this is a fraudulent scam.  Good luck finding her.  It was even mailed insured with delivery confirmation (though the tracking number she gave me was also wrong.)  The item descrtiption was 1 Ounce Fine Gold Coin...no where does it say chocolate candy coin!  HELP!

I am escalating this case to eBay Customer Support for item ------------ because the buyer in last eBay message said, "PayPal will have to make a decision on this case". After checking for how much coins like mine were selling on eBay, I decided to try and sell my coin on eBay instead of to a coin or gold shop (they were selling for more on eBay). I described the coin accurately including condition of coin, images and letters on coin. The winning bidder didn't pay so I did a second chance offer. This item sold through a second chance offer. After shipping the coin, I sent buyer a eBay message with USPS tracking number --------------------. When adding tracking numbers in eBay, I put wrong tracking number -------------------- and let the buyer know what happened. The item was delivered at 12:33 pm. Buyer opened case at 12:20 pm (13 minutes before delivery) and before I had a chance to contact buyer. Buyer is claiming of receiving a piece of chocolate in gold foil with the date 1981 on it. I sent a real coin to the buyer, but buyer is insisting on receiving a piece of chocolate. I had different kind of coins (including gold) and know how a gold coin looks and feels like. Buyer insists on a refund before returning the item. I would've probably gave the buyer a refund (even though my listing said I don't accept returns) because I know the value of that coin and the possibility of it selling higher, if buyer returned the coin that I shipped and not what the buyer wants to return - a piece of chocolate (I can't accept that for a refund). I also asked buyer if the packaging seemed like it was opened before receiving or if there were any rips on the packaging, but the buyer said that it was intact. I did everything according to eBay policy - describing the item accurately, shipping item on time, and working with the buyer to determine the cause of this case.

Why did eBay close the case in buyer's favor? Did the buyer provide a police incident report? The buyer claimed receiving a piece of chocolate. This case was opened by the buyer as "Item doesn't match the description". Why is eBay lying? In "eBay Customer Support comments:" eBay wrote "The buyer claimed that they received an empty box." If the buyer is claiming now that they received an empty box, why are you believing the buyer after the story changed? First the buyer claimed to receiving a piece of chocolate and now the buyer is claiming of receiving an empty box. How did the buyer receive an empty box when I shipped the coin in an envelope and the weight on the receipt was 1.10 ounces? I even took a photo of the coin and envelope before shipping. My listing stated the weight of the coin as 1 ounce and the envelope weighted probably about .10 ounces. I feel that eBay always sides with the buyer no matter what the evidence is. So what am I supposed to do now? This is not funny, I don't have the coin or the payment for the coin? If the payment isn't refunded back by next Tuesday (1/8/13), I'm taking legal action. What I want is either the coin that I shipped to the buyer (not the piece of chocolate the buyer is claiming on receiving) or the payment for the coin.

Also, does eBay know how to use a spell checker? They forgot to put the word with.

that story is crazy what the hell. I agree with you on most things you said, but did you ask the buyer how he found out it was a chocalate coin, so he pulled it open?? Photographs?

Either someone has robbed the contents of your package and replaced it with a fake package with a chocalte coin taking th p1ss, or the buyer is just fcking you. I would say its the buyer to be honest, but if it was worth £1600 I wouldnt send that by normal post.  I think your agrument is pretty comprehenisve considering you have all photos, proof of dispatch, delivery, weight,  and the fact the buyer chanegd his story. And the fact that you have not received your good back. Ask them to provide the product itself or detailed photographic evidence of the item and packaging received by the buyer. If you send them notification of real legal action they would be mad not to review the case again.

That is such a horrible ordeal to have to go through. I am currently going thru something similar but my item cost about $65.00. The buyer received the item and the refund even though I submitted tracking information.The buyer insisted that she never received the Android tablet and therefore was given a refund. So now she has the tablet and the money. My balance is now in the negative but I do not plan on paying Paypal another dime. I honestly believe that they are in on the scam. They not only decided in her favor but also deducted money from my Paypal account that belonged to another buyer. I had to purchase the item from my own pocket in order to ship it out to him. This is more than disgusting, they are thieves and deserve to go to prison for stealing from sellers.

I am in a similar situation.

 

an ebay buyer filed a claim saying an item was cut, but admitted to opening the package with a large knife and cutting it himself.

 

I offered him a partial refund, or full refund upon return.

 

He isntantly escilcated the claim saying i refuse to refund him, which wasnt the case.

 

He has since been sending me threating emails, claiming hes going to keep the item, send me back the wrong item, ect.

 

I have provided all this info to paypal, and they still sided with him. He told me hes going to send me back the wrong item so he can keep the money and the item.

 

No one seems to care.

 

So aggravated and now im out the $200 item, and $200.
