Scammed as friends and family apymebt

Hi everyone! I did a transaction outside of eBay with an eBay seller (I have all our eBay messages saved) and to save money on the shipping they sent me a bill for a bag I purchased, they must have sent this as "friends and family" Long story short, I got the bag, got it authenticated and it is fake, I sent the bag back and PayPal was to refund me tonight after closing my case! Then I get an email saying they won't refund me as this payment was sent as friends and family. I have been in contact with PayPal 7 times since the incident and I have yet to have had someone before tonight mention anything about friends and family, all I've been told is case will be closed in my favour once the bag is sent. I obviously was unaware I sent the money to the seller as friends and family and this scammer won't refund me! PayPal isn't being helpful but they did decide to appeal the decision and I also contacted my bank and filed a dispute against the charge. I feel like I have done all I can. Has anyone else dealt with this?! The transaction was done through my bank account, not credit card unfortunately!

I dont know of any bank which will get involved with your purchase.

if someone fraudulently used your account ,yes,but not you bought a fake handbag and returned it and now seller refused to refund,thats not what banker and banking is all about.

someone wiser than me may chime in and give their insight

Hi! My bank has been very helpful and they sent in a request for refund on unauthorized charge. PayPal actually advised me to contact my bank. This is considered fraud in my country, Canada. And I have proof the money was sent to an eBay seller, not friends nor family.

Not familiar with CANadian bank,but is that a LIE?

Unauthorised charge??,you know what you are doing,you receive the handbag,you return the handbag ,it has your fingerprints all over it. 

But if he is  decent seller,he should refund since he has the bag back.

I'm not quite sure what you're trying to get to. PayPal advised me to contact my bank, it is not a lie, I did not authorize a payment to anyone for a fake bag! I authorized a payment to a seller for an authentic bag! No, they are not a good seller because they would have refunded me when I sent the bag back (which cost me $170, on top of duties, by the way) and no he is not a good seller when he sells a bag claiming it is real, and it isn't! I am at 1800 lost money and I'm asking for help or thoughts on if this has happened to anyone else! If it has not and have nothing more to say, then I'm not interested on other responses. I'm aggravated of being scammed and am asking for thoughts on anyone else that has been scammed the same way!

it's not fraud if buyer didn't receive the item that was purchased. same as if buyer hadn't received any item or if he had received a life-sized darth vader action figure instead of the fake handbag.

My understanding of UNAUTHORISED TRANSACTION is that I did not authorise the transaction,someone else did.

This is not the case,he authorised the transaction,they avoided Ebay and Paypal fees ,so there is no Ebay buyer protection and no Paypal buyer protection.

So his last resort is credit card chargeback.

It should be the item was not as described,it was a knockoff/counterfeit and he has returned the item and did not get a refund.

He has proof that he paid for the item,proof that expert said it is not authentic and he has shipping to prove he returned 'something'.

No one knows what he returned,but cc issuer usually sides with the buyer,plus if it is a counterfeit,it does not have to be returned,he will be asked to destroy the item and get his full refund.

I think you are missing the point of what I'm trying to do with this post. I'm not here for your opinions, PayPal advised me to contact my bank and start an investigation against this charge (notthing about unauthorized charge was mentioned, if that's the lingo I used in my previous message, my bad, I was writing quickly and looking for an answer) I am looking for some hope, I'm asking if Anyone has ever been able to et their money back when sending money as "friends and family" even though they are not friends and family! I don't care about what the seller should do with the bag not anything else, I've lost a lot of money and did all I could as a buyer to get it back but seller won't respond to my messages, they knew what they were doing in the first place! So, my question again, has this ever happened to you or have you heard of anyone successfully getting their money back? I'm at a loss here and it isn't looking good!

The only way with friends and family payments is to file unauthorized use dispute at PayPal which in your case it isn't. But if PayPal advised you to go to your bank, maybe the bank can file a reversal for you. We do not know what your bank will do so you have to sit and wait.  Did your bank file an unauthorized use complaint with PayPal?  If PayPal replies that the payment was not unauthorized, then your bank may not refund you.

If this bank reversal thing falls through, file a complaint with BBB.org and they will direct it to PayPal office of executive escalations where they will investigate and depending on the amount, might offer a customer courtesy refund.  How much money was your purchase, may I ask?

Well, we mostly prepare other users for the worst Smiley Happy so then it would be joyful if they succeed in getting their money back.  The OP did not pay by credit card by the way.
