Never Recieved Item, Seller Dispute Denied, What do I do??

About 3 months ago I bought a laptop on ebay from a seller and for a bout a month and half of messages back and forth about when I would recieve my laptop, I decided it would be better to open a dispute and get a refund. However, for whatever reason, Paypal declined my claim and is now forcing me to pay for something I never recieved. Is there anyway I can have a re-claim done? Thank You

I kind of figured your claim was for not received so it would be an immemdiate denial.  It's important to provide those details with the OP; it would save everyong a lot of time.

As for the seller on eBay, I would not put much stock in positive feedback as a lot of buyers just do that to be polite.  The approach I use is to contact the seller and ask questions; intepreting how the seller responds to multiple questions will tell a lot,  Google searches are also important.

 

Neither eBay nor PayPal will protect a buyer from poor judgement.

 

Hopefully you will be able to re-open the dispute for not as described.  If successful it might even create searious problems for the seller.

What countries?

Does tracking show the item delivered?

 

Why didn't you file a claim as soon as you learned it wasn't delivered?

It stayed within the United States. The whole issue is that when i purchased the laptop, it had a extended shipping time and, although after first I was going to cancel my order, decide I would wait a couple weeks until it shipped. Keep in mind, I was speaking to seller a least 4 times a week and sometimes more, asking when my laptop would be shipped. The seller sent a walmart gift card and used the tracking number that was supposed to be for the laptop to send the package. The seller also sent a piece of paper saying "Thank you for pre-ordering". At this point I was becoming impatient and was suspicious about the whole thing.  So I finally decided to just open a claim about a month ago and I just now recieved a email from paypal saying my claim was denied and that would have to pay the amount.

There were so many warning signals from the start.  Apparently you did not investigate the seller very well before the purchase.

Purchasing computer online from a private seller is extremely hgh risk.  Accepting a long shipping time was a big warning  BEFORE you made the purchase.  Receipt should have been expected within a week.

Repeated comunication was a great stalling method for the seller.

Scammers will send an envelope with a tracking number to show delivery; that's what it's so important to buy from reputable sellerls.

 

What was your specific PayPal claim, non-delivery?

 

Did you phone PayPal customer service for help or for an appeal?

 I actually got it sorted out with paypal customer service just now, at least for now I think, but the big problem was that when I set up the claim, I told paypal I did not recieve my item which is true, but because a tracking number was a sent and I indeed received a "item", paypal saw this as me recieving the laptop I purchased, which I did not. Instead, I recieved a gift card. The seller has sold a lot of items on ebay , well over 300 feed back ratings were made, so it wasn't a matter of a seller who had just made an account the other day and has some weird username, it was just the seller giving me the run around for no reason. And now looking back at the seller's page on ebay, I'm seeing alot of their customers who did not recieve their item and are going through the same thing.

if this is Ebay transaction,you should h ave file item not received as soon as the estimated delivery time is reached.

But now ,you need to re -open the case as item not as described,stating you receive a gift card not a laptop,if Paypal allows you to re open the case,robot will ask you to return the gift card with tracking,once tacking show delivered,case will close and money refunded.

Or if you cant re-open the case,file the chargeback with your cc issuer,if you  win and keep the gift card.

also you can call Ebay and ask what to do,point out the estimated date is long thats why you have not open the case early

is he really US based seller?

how long is the delivery date?

He does not have the item and rely on dropshipper to ship your item,either the item is out of stock or price is too high ,he would lose money so he just ship a gift card and hope he will win the dispute

you can pull contact information on Ebay and call him,if you still want the laptop

The seller would be banned from Ebay soon.

There are many electronic sellers who post a stock photo and once he recieved your payment,go to a distributor or dropshipper to buy the item.

Dropshippers buy closeout and once sold,it is hard to re-order at a discount price,many are also disorganised,cant find the item or send the wrong item or send too late or poor packing.

buy from sellers who has high feedback ,or buy from stores.
