I was scammed out of $1000. Need help urgently

Long story short, I was scammed out of $1000 and I have irrifutable undeniable proof of it through email. This was not done through ebay or anything. This Person changed their mind about the item they were going to sell to me (it was a digital item) and said they will give me my money back in 2-3 days. I instantly knew I was being scammed at this point because it takes 4 seconds to send someone money. Here is what they are doing I think; they are waiting 2-3 days so the money can go into their bank account and paypal wont be able to do anything about it once its there.

I have opened a dispute, and this person I know is not going to respond to my messages on Paypal, I just want Paypal to put a freeze on the money being transferred into his bank account. He is not going to send me my money back. It says if you do not recieve your item by October 20th (which is today although it is 4:30 AM), you may escalate it to paypal. There is no option anywhere to escalate it to paypal at the bottom. I know in a day or two this person will have the money transferred into his bank account and I just want this person to not get the money, even if I cant get it back I just dont want them having it! I also emailed spoof@paypal.com telling them to freeze their account now to investigate, no response. Is there ANYTHING I can do? How long should I wait before the escalate to paypal button shows up? Because it just isnt there. This should be a very simple thing easily fixable, but I wish someone would help me. Thanks to anyone that can help.

there is no seller protection for digital goods,so he would lose.

it does not matter if he transferred the money to his bank account,if he loses the dispute,Paypal will ask him to come up with the money.

if he has done so already, then his account is now negative and Payopal will ask him to bring it to neutral .

try getting PAYPAL to review your case.

You are the buyer, correct?

You should have known not to purchase a digital item.  It was at extremely high risk.

However, since there is no online tracking to show delivery you might have a chance for recovery.

If your dispute was for non-delivery, then escalate to a claim as quickly as you can; don't delay!  PayPal would then make a decision after 10 days.
