Buyer Protection Issue

I purchased a guitar and payed through Paypal with Buyer Protection. The guitar was received from USPS with a broken neck. I contacted the seller to let them know and to request a full refund. The seller said he would not refund my money until USPS paid the claim. Since I was protected by Buyer Protection (I thought), I waited for some time for the seller to get reimbursed by USPS. As part of the USPS claim process that the seller filed, I had to turn the guitar into USPS for inspection.

 

After some time of not hearing from the seller, I decided to open a Paypal dispute for the broken guitar. Paypal ruled in my favor and the final step was to return the guitar to the seller and provide a tracking number. Ummm, the guitar was turned over to USPS as requested by the seller. Paypal then changed their ruling. I appealed the ruling and provided the USPS claim letter sent to me by the seller requesting me to take the guitar to USPS and the USPS receipt when I handed over the guitar.

 

PAYPAL ruled against me again stating that the documents I provided didn't satisfy Paypals policy. It also stated that I am engaged with a third party and that I have to resolve with the third party and the seller. I am not engaged with a third party. The seller is engaged with a third party. I just delivered the guitar to USPS as requested by the seller. How is that not the same as returning the item to the seller?

 

Has anyone else been through this?

 

I just realized that I had said "USPS ruled against me again" at the start of the third paragraph. That changes the meaning completely. This may have been understood to mean Paypal and not USPS by the responders. I apologize for that mistake.

Actually, it's from a business point of view, but you did agree to follow PayPal policies and accept PayPal decisions.  There isn't really another other valid point of view other than the legal issues of accepting PayPal policies.  You can check the legal agreemtns link at the bottom of the page for more information.  Everything you do is within those policies.

 

In life there are a lot of legal issues where we accept legal contract issues and limitations.  Those agreements are so that lawyers no how to decide on issues.   Legal agreements are a great place to resolve in court.

 

I think your effort would be better spent in filing a legal case against the seller who refused to refund.
