I bought an iphone and when it arrived it wasn't working. The seller has been very nice, but has asked me to return the item to see if she can get it working. If she cannot she said she will refund me. Is this the right way to things or should I go through eBay resoloution and open a dispute?

Up to you how you do it, but if you return it make sure you send it trackable to prove delivery of the item back to the seller in case you have to open a dispute at a later date.
