An unresolved dispute escalated to Paypal to be closed instantly

Today I am feeling screwed big time. 2 weeks ago, I opened a dispute against a seller for not shipping one of my 2 orders. When i inquired about my unfulfilled order the seller provided the shipping / tracking information of the other order, basically a wrong information, after taking them a week to respond. I followed up again but still no response. So today I have to escalate to Paypal as the dispute will close soon, unresolved.
As soon as I escalated it to Paypal, detailing what happened, I immediately received an automated email from Paypal saying that the case is closed and "investigation" is concluded because the seller has basically responded, despite of the fact that they did not answer my inquiry. The seller, by giving false information, essentially said this orange is the apple you are asking. And that according to Paypal is good enough So Paypal has closed my case.
When I escalated to Paypal, I was hoping for an unbiased individual to help review and resolve it. I did not expect a machine to respond. Otherwise, with the details I have provided in an orderly fashion my case would not have been closed that instantaneous had there been an actual living person reviewing it.
Is there someone with this kind of experience can please provide some guidance? The order cost $178 and I see no delivery. I feel like I am screwed royally for escalating it just to have it closed immediately. Where is the buyer protection when you need it? Could someone please assist and give some light?
Sincerely thanks,
Dan

Im sorry to say there isn't a damn thing you can do i just got the same thing a few minutes ago. I orderd a tablet recieved it and it was damaged and not working, so i emailed the seller and was told to send it back and they would replace it or refund my money i chose a replacement since it was a christmas present. I returned the damaged item with signature request so i had proof they received it. I got the confirmation email from the post office and i have all the emails between me and the seller saying they had shipped the item to me on the 19th but when i ask for a tracking number i never heard back. I open a dispute and sent all this info to Pay pal and it took about a minute for them to close my case saying that the seller had proof they shipped the item. Well of course they have proof they did ship it the fist time, this is the so called pay pal protection an automated machine that just closes cases without looking into anything!!!! Its bad enough getting ripped off by these so called sellers and then pay pal just bends you over and sticks it to you too!!!...And when i looked alittle further it states you cant reopen a case that has been closed. Im just thankful that they only got me for 57.00 and the 13.00 to ship it back i will never use pay pal again there no help.

I am going through the same thing. The second I clicked "buy" the seller ceased communication with me. I filed my complaint with PayPal and PayPal quickly sent me an automated email stating the seller has shipped and I had recieved the package and it was confirmed by PayPal. Well, the tracking number was generated by PayPal, but when I checked the tracking number it was bogus. Immediately after I clicked "buy", PayPal generated a tracking number that stated item as shipped. Really! Its that freakin quick, huh. PayPal seems to be able to check on the package and state it was delivered but it appears to be a false tracking number to me. Apparently, any seller can pull a few random numbers out of thier a$$ and call it a tracking number and PayPal stands behind it. As far as I am concerned, PayPal is complicate in the fraud because they created the false tracking number that the seller is using as his defense.

I think you have to wait few days or 1-2 week for the item to come. Quickest way to check is call the seller's customer service. I only contacted Paypal when I did not hear anything from that seller for almost a month. Anyway, it is frustrated to be in our situation. Keep following up one way or the other. You have the evidence against seller or anyone that you have not received your stuff. Cuz when it comes to law suit, it is so easy to track it down with email back and forth and whether or not seller sends your order (it should be in their system). Good luck!
