Chargeback and negative balance

I have been using Paypal for more years than I care to rememeber. I sold a phone to some who I though was a legitimate buyer. They paid for the phone after a few discussions. When they paid for the phone there was no address on thier paypal account showing and they emailed me the address. We had been going back and forth for some time so I genuinely did not suspect anything. I sell online a lot and have sent items to other european countries without a problem. I have sent many things to Poland and this particular buyer was also Polish. 

 

Everything was complete and I sent the phone to the buyer. I sent it tracked and signed for. However about a week and a half later there was a case open for unauthroised use and the money taken out of my account and I am now in a negative balance. I have gone back and forth with Paypal they have closed the case and then reopened it and are now dealing with it as a chargeback. I have now been advised by paypal not to do anything and wait for the outcome. So until then my balance sits as negarive. 

 

I am on the phone to paypal almost everyday. Their collections teams rings me almost every other day and even though there are now four notes on my account for the collections team which state I have been advised to not doing anything until the outcome of the case they keep pestering me to resolve the negative balance. 

 

What is the likelihood that I will get my money back? Any one else had a similar experience. I am honestly so annoyed with paypal and how they allow people to get away with this kind of thing. The phone I sent has been posted and delivered which I have proof for. 

 

If this was a genuine unauthorised transaction why am I being punished for paypal allowing people's accounts to be hacked into! It just frustrates me that I could lose out on a lot of money because of this. Paypal do not seem to want to help at all. They protect buyers but not sellers.

Phones are high risk.  And when you sell something, you either set up a PayPal generated email link where you require that the buyer provides an mailing address with payment.  Or send a PayPal invoice, NEVER just allow the buyer to send you money their way, i.e. such tactics as not providing mailing address with payment.  You can lose your seller protection.  It would help if folks read up on seller protection before selling.  To be covered, you are required to send to address on the payment and the transaction is marked as eligible for protection.  Was the payment transaction marked as eligible for protection?  PayPal can protect you from unauthorized use chargebacks but you have to follow PayPal protection rules.

 

You may have to chalk this one up to lesson learned.

since you said the payment notice from Paypal does not have his address,is this payment made under friend and family?

Friend and family payment is considered gift,not business transaction.

to get seller protection for unauthorised transaction,you must show you have shipped,not necessarily delivered to the address on Paypal payment notice and the item must be eligible for protection.

You failed Paypal seller protection.

As to your negative balance,you would have to cover such,if you lose the chargeback/dispute.

all future payments would be used to cover the negative balance until it is no longer negative ,but better to cover soon with your own fund if you think your near future sales is not enough to cover the deficit .

iphones are much sought after in Eastern Europe,some folks are good at scamming iphones and they know how to work the system to get them free.

You should have send them a paypal money request under goods and services ,pay PAYPAL fee and get protection
