I am just wondering what I can do about the issue of an item being delivered to an unknown address and signed for and how this affects buyer protection and the dispute process.
I ordered a £210.00 console table from retailer Perch and Parrow on 11th of July, it says on their site that they would contact me prior to delivery but this did not happen. Wednesday the 17th of July, I received a text from XDP courier saying my item was out for delivery and would be delivered between 12:00hrs and 14:00hrs, I was working during these hours and there was no option to contact the courier and reschedule so I assumed that the delivery either would fail or it would be delivered to a neighbour and a call card would be left.
When I returned to my property at 21:00hrs, there had been no card put through the door and no neighbours have approached me on either Wednesday or Thursday to inform me they had my parcel. In addition to this, the XDP tracking remained ‘SMS sent’ until Friday morning, in which it then said ‘Delivered’. This is when I contacted P&P. I spoke to a staff member who advised she would need to investigate with the courier and would get back to me, which has yet to happen.
As XDP have not left a call back card, I feel like I am expected to go door to door in my building and ask neighbours if they have received my parcel. I am new to this building and have had a bad experience with the male below me who is an alcoholic and has mental health issues and I am too frightened to approach his address myself. I have tried to, but when push came to shove, have just simply been too scared to do so. I also have posted on a community Facebook page, asking the person to return the item too.
I have opened a dispute with P&P on the grounds of Item Not Received as I have not received the item, however I am aware that I am going to lose this dispute as P&P can argue that they did deliver and have a signature, even though it is not mine and was not delivered to my address. I now do not know what to do. I stupidly assumed that I would be covered as a paid with PayPal but this issue of items being delivered and signed for by someone other than the buyer has proved to be a loophole and now am I right in thinking that I could be facing a loss of £210.00 now?
Any advice on how I can proceed with this would be so appreciated. For anyone offering legal advice, I live in Scotland and I have yet to explore the issue of taking P&P to court.
