Found out something interesting... you can protect yourself as a seller when using pp on ebay:   http://slickdeals.net/forums/showthread.php?t=2716225   Read the first two posts, it can save you tons of cash in the future and you won't even have to post anything here because they won't be legally allowed to dip into your account.   Sorry you haven't heard much from me in the past 24 hrs, mods. I took it upon myself to track down[LexxisNexis/Accurint is full of win] your entire board of execs and some project managers that have degrees relating to my case. Olivia... because I am online at all times... I am a member of the largest buying, deal, and tech forums on the internet according to Google Analytics...   When buying anything from a new online store, or a store that may have mis-priced something, the typical response from users[buyers] is "use paypal so you can't get **bleep**ed". I can literally post you a thousand threads with that exact message if you doubt what I say. So no, MOST buyers do NOT feel that way. It's just not true. In fact, you say you will ban accounts with multiple disputed infractions/transactions, but someone who does 10,000 transactions is more likely to have three, than a buyer who has made three total transactions.    Whether or not the equality 'attempts' are actually "TRUE" is another matter, but the example you posted[about two equally 'perceived' bias feelings] and the quote with it... are flawed. This is somewhat due to the fact that paypal has no real say when it comes to chargebacks and also that paypal more often than not sides with the buyer even if by default [harder to prove they are lying]. While several natural tendencies may lead to that, as well as other points stated above, the end result is far in favor of the buyer when dealing with transactions. The flaw here is that sellers want to be here for longer than buyers, and even if you had equal complaints, there are far less sellers [according to released ebay data years ago when the aquisition took place].    If you perhaps had some hard numbers, that would be wonderful and a step in the right direction in showing both sides.  ... This... this is true. I never thought about some of what you wrote. So what you're saying is, I can re-dispute if those conditions are not met if he even sends? I don't recall seeing that in my rights / resource center section or any paypal documentation regarding this... Am I overlooking a link that is right infront of my face? ... View more

Also, you keep using these general terms as if this is a general case or issue or even item. Why do you insist that this i like buying a box of cereal. It isn't. It's insulting to my intelligence. I'm sure your words fit ninety percent of cases. That's fine, and all, but this is not a case like that. Even your own statements are criss-crossed... you said you don't prefer one over the other, yet say generally the seller can return [even if they damaged?]. Bestbuy wouldn't even allow you to return a cellular device this late, and Verizon would've charged a 200 or more ETF fee or given less than i offered the guy for the device minus EBAY VERIFIED flash / esnservices [i bought them on ebay on purpose to avoid this kind of thing]. General is for items that aren't modified, normal things, not high end smartphones at 1ghz with everything changed and made to order. ... View more

Yes, but I can't break[for software, we call this 'bricking'] a cellular device and return it to most retailers. Even on Verizon's OWN TRADE IN feature, the first bullet is "the item must be working". That is THE retailer for the device. You are simply not listening to what i am saying, or the policies of the original retailer itself[which you are attempting to emulate]. The buyer can't argue with the invoice. Feelings are not the same as facts. VAlidated? HE CONFIRMED that it was exactly as i said, and i sent that info to paypal. I even have a backup of the NAM info I used to flash it. I literally even took pictures of the device connected to a metro network. Yes, you can't be there for every bit, which is why I log everything, and can get all original docs sent from google or aol or whomever you need through my lawyer. I keep records like no-one you've ever met before.   Returning the item is NOT the best case because of the costs to flash and get the ESN added to the inventory[AGAIN] which only lasts for about a month or less[before it is released and banned FOREVER] . Meaning, He would be returning something HE bricked after a THIRD party was allowed to MODIFY the device and THEN the esn cannot be activated on ANY cellular carrier by the time i get it back. Literally, the software in this case is worth[was] more than the hardware. According to your OWN policy, it MUST be returned in ORIGINAL condition, which he won't spend the cash to do, or refund the difference for [which i already tried to do with him, so much for taking the high road]. It is literally impossible for your own conditions to be met, and is [at least in my state, i checked already regarding unsubsidized cellular devices] FRAUD.   Also, the claim was already made, it just said he has to send back according to you guys.... :   "Case number: PP-001-206-360-534 Refund amount: $230.00 USD We've determined that the buyer should receive a $230.00 USD refund if they ship the merchandise back to you. The merchandise will be in the same condition as when the buyer received it and the buyer is responsible for all shipping and handling costs."    So wait wait, what you're saying is... he gets a free pass and i end up with zero. Great. So how many times does it take to happen? Can he scam one or five...ten? If you have a ferrari, i'd love to buy over pp so i can burn the clutch and return it to you.  ... View more

The issue with eastern europe is simply that the info paypal requires for a reversal when the buyer is a fraud, is impossible to get with the shipping carriers from the USA to there[and the euros know it].   The only way is to not sell to them because paypal would rather throw you under the bus than crack down or eat the cost [both of which cost them money]. This 'risk' would also be true, except that i submitted AIM logs to you guys with the buyer reading me off the PRL {Prefered Roaming List} file number that was currently on the device, even after he modified it[the device, not the roaming file] without permission. The PRL files are unique to each carrier, and the device was flashed to another carrier. It is literally impossible for the device to not be exactly what I said it was given the fact that NO verizon phone can EVER come [stock, meaning i modified it beforehand] with a MetroPCS PRL file. It is simply not possible. Also, the buyer was whining about having to roam [because as stated in the invoice, the hardware/device is a dual band device, meaning it has to roam/etc in tri-band areas] yet it is a hardware limitation that NO device in the entire world with that same model title [HTC Incredible] can ever make non-roaming calls in a tri-band area. This is even on the manufacturers website, my invoice, and Metro themselves will tell you that. I also showed paypal the metro dual band coverage area over the buyers state / county / house... which I shouldn't even have to do[they say full coverage]. I shouldn't be responsible if someone has a tin roof [not in this case, but you get the idea].   There should be no risk. The only risk is that your employees don't know what the **bleep** they are looking at when making these choices for hundreds of dollars. Are you telling me that paypal's largest flaw is ignorance on their behalf? That shouldn't be a risk I have to take... or anyone else... imagine for a moment that someone sold a high end [purpose built] server cluster for scientific calculations. Are you saying that technical devices should not be sold using your companies' payment method because no-one in a multi-million dollar company[they do, but won't... as it's the department] has the background to judge such things? If i buy an ipad at bestbuy, and return it because it won't blend my smoothie, is that valid? I see no risk, as I did everything I said I was going to do, flawlessly. I fail to understand how a seller is responsible for USPS / UPS / FedEx? At worst, the claim needs to be made with them, not sure on which side of the fence though. It could have looked brand new prior the shipping.  ... View more
