buyer had item for over 4 weeks. now saying he only just tried it and not working this was a new item and tested and working fully when posted..can anyone advise please

We can't really answer that here.
Has your buyer opened a dispute? If not then i would hold fire until they do.
Then leave it to paypal to decide as they "may" find in your favour.
If they find for the buyer however you should wait until you have the item back before you refund.

the buyer has opened a disspute and i have taken it to a claim,i know the item was fully working when it left my hands and has been with the buyer 4 weeks now .i have had nasty mail off the buyer on ebay but mail sent to paypal was very polite from him. pay pal have put my account in arrears , it isnt fair and i am worried the buyer will get his refund without my say so.
