If Paypal refuses to handle case, will VISA chargeback do ?

Hi guys,

 

First quick explanation of my problem: Bought a phone on eBay from a seller with 100% feedback score. Phone arrived few days later, I was very happy with my purchase. Until about 3 weeks later the phone does no longer connect to the mobile phone network, other functions are fine. Contacted mobile operator and was told this phone was actively barred from the network as its IMEI-number was on a register of stolen/lost phones. I was unaware of this when I purchased the phone. eBay advised me to contact the seller first before filing a case. The seller has refused to give an explanation. He also refuses to refund. To make a long story short, this took longer than expected because of seller dragging his feet to communicate and me getting stuck abroad because of closed UK airports.  😞

When trying to file a claim in the Resolution Centre on day 45 after payment the 45 day deadline apparently passed. eBay now refuses to handle this case because it can hide behind the 45 day limit.

 

I am now contacting police but my dilemma is: I will probably have to hand in this phone but with the current way our law enforcement in the UK prioritises its work it is unlikely to be followed up on and I should certainly not count on getting my money back. I am not hopeful they will even contact eBay for this matter, which means noone is going to move and bucks are being passed.

 

My Paypal account is coupled to my VISA debit card and I was made aware that VISA has a much more customer-friendly process to dispute malicious payments then Paypal has. Apparently I can ask my bank to initiate a chargeback procedure until 120 days after payment in case items I bought with this debit card do not arrive, are broken, fake or stolen.

 

My question is:

Has anyone here have any experience with this procedure ? And specifically to dispute a payment from a VISA debit card via Paypal to another Paypal customer ? What would happen in case it was successful, Paypal needs to refund me or are they then getting this back from the seller ?

I went through the procedure with my bank today and found out that I would have been eligible to initiate a chargeback, if only I hadn't given Paypal the authorisation for a Direct Debit on my account. Because of that, this payment was not being paid for using my VISA debit card and therefore is not covered by the VISA debit chargeback scheme. Very unfortunate, I can kiss my cash goodbye I guess. 

 

I would advise everyone to cancel their direct debit with Paypal and from now on just make the transaction with Paypal go through your card. This would ensure that you have proper coverage against dodgy transactions. Maybe a bit more of a hassle, but sure worth it because eBay Buyer Protection has little value when one actually needs it.

I am sorry to hear about the problems that you are having in regards to the item that you purchased.

 

Unfortunately, we are unable to dispute any transactions that are filed after the 45 day timeframe. If there are multiple disputes that are filed after this timeframe against the same seller, we may be in a position to reopen the cases but we wouldn't be able to guarentee this.

 

I am sorry to hear also that you don't have any protection on your purchase with your bank. The best thing I could advise you would be to contact your local police and your local citizen's advice bureau. If your local police require, they can contact us and request any information regarding your seller that they need for their investigation. Then this may also assist you in obtaining a refund if you wish to take court proceedings against your seller.

Paypal puted my paypal in 9 000 usd in minus for transaction older 45 days + even older than 180 days 


so what you state is not true
