Did PayPal just made refunds more expensive ?

I bought an item which turned out to be not as described.  I caught this listing error before the  seller send out the item. So the seller refunded me .

I paid 537 €  I got a refund of 499 €.  38 € or 7% disappeared ??????

Seller should have given you a full refund, they have chosen to part refund so you pay the fees that they were charged.

If you open a dispute for non receipt of item (they are not going to send it now that they have part refunded) and escalate to a claim, you should get the rest.

I just tried to open an item not received case as advised but I can't . Paypal says I can't open a case for this item

There is one other case. I bought an item and the seller couldn't deliver. Once again I lost 7%

Seller says they refunded me full price of what I paid.

So as buyer I have to pay 7% everytime seller screws up a listing. How is it justified?
