Does PayPal Condone Theft?

I am confused about the process PayPal takes when HELPING sellers dispute a claim. I have a buyer who states the item was significantly different from the one described (which is wasn't), but she REFUSES to return the item to me. I have emails that I sent to the "PayPal Dispute Specialist" where the buyer has eluded to the fact that she has NO intentions of returning the item.
I have been told there have been cases where the credit card company allows the buyer to keep the item AND issues a refund! Say What? This is definitely a scam, and I am NOT satisfied with the process of "protecting the buyer". Has anyone else had this issue?

10.1 Your Liability. You are responsible for all Reversals, Chargebacks, Claims, fees, fines, penalties and other liability incurred by PayPal, a User, or a third party caused by or arising out of your breach of this Agreement, and/or your use of the PayPal Services. You agree to reimburse PayPal, a User, or a third party for any and all such liability.
Liability for PayPal Claims. If you are a Seller and PayPal makes a final decision that you lose a Claim filed directly with PayPal, you will be required to reimburse PayPal for your liability. Your liability will include the full purchase price of the item and original shipping cost (and in some cases, you may not receive the item back). You will not receive a refund on your PayPal fees. PayPal Seller protection may cover your liability, see section 11 below.

While the member above posted the user agreement which all PP members should be aware of, I wanted to add that if you used the USPS to send the package originally and the buyer receives a refund without returning the package, you could then file a claim with the USPS postal inspector for interstate mail fraud. He or she would have received goods with the intent of not returning them to obtain a refund. I am not saying file a complaint right now but depending on outcome this is always good knowledge to have. A google search of the USPS postal inspector should yield some good information. As a general rule, anytime you write the USPS postal inspector be sure to submit the tracking information you have for the package so he/she can find it easier.

Thanks for the advice about the USPS, but I sent it FedEx. To the other individual who posted, I don't care what the "clause" state. Theft is Theft..Period! If I don't receive the item from the buyer, and she gets a full refund that is CRAZY! If you think it is acceptable, then I would like to see you pay a 405.00 fee and a person has an item of yours that is worth 500.00! I think that is UNFAIR and IRRESPONSIBLE on PayPal's part to endorse this type of behavior!
Futhermore, I fault PayPal for not working harder on the buyer's behalf. I will take the buyer and PayPal to court before I pay that 405.00! It is the principle of the matter! I have a plan of action to ensure NO ONE ELSE endures the foolishness I have experienced!! I GUARANTEE YOU of this!! PayPal get ready for a fight!

that "clause" is a contract you signed when you clicked " I agree" stating you agree to reimburse a user, third party, or PayPal for any an all liabilities. And really? You would go to court over $405 just to lose and have to pay court fees too? Take the loss, when you sell on Ebay(or anywhere online) you are acting as a business, and every once in a while things like this happen to businesses, and they take a loss. When you signed up for PayPal you agreed that you would abide by the decision of PayPal in any investigation regarding any of your transactions. Oh and by the way, principal doesn't always matter.

Why do you care! Do you work for PayPal? I will win the case because I don't have the item and PayPal wants me to pay the fee. I am not worried about winning that is in the bag! I signed the agreement and expect the item to be RETURNED if the buyer wants her money back!
You can't take an item to the store and request your money and KEEP the item!! Don't worry I will update once I win my case AGAINST Paypal...LMAO!! Would you like to represent them in court, since you are so **bleep** concerned! I would like people who understand the situation to cpmment and NOT losers who work for paypal and are on the post defending them! By the way, I plan on suing for more than 405! GO TELL YOUR BOSS THAT!! LOL!!
