Buyer renegged

I sold an item on eBay in June.  The Buyer paid for it, received it and left positive feedback.  Then at the end of September, she initiated a chargeback.  I never received an e-mail from PayPal (it may have gone to my SPAM).  The chargeback closed in October and I've been slapped with a $20 fee.  Plus the Buyer still has my item and has now never paid for it!!!  When I talked to "Ashley" with PayPal tonight, she said they can't do anything about it.  They can't open up a new claim.  "It's a risk selling on the internet.  You may be out your item and your money.".  That's the warm and fuzzy I got.  Is there any way to file a claim or am I just **bleep**ed?

First I would gather up all your proof of delivery information and make copies of it.

Then I would send a strongly worded letter to the buyer via certified mail, return receipt requested.

I would let the buyer know that they should either pay you for the item or return it within 10 days and provide you with shipping proof.  If you have a friend that is an attorney, have them send the letter on their letterhead!

If they do not respond, then take all of your information down to your local police department.  What they did was theft and yes you can press charges against them. 

If by any chance, you shipped through the US Postal Service, you can also contact your local postal inspector as they used the postal service to conduct fraud and that is a federal offense.

I know how you feel....I sold a Magic Johnson autograph 16 x 25 framed photo for $200.

The buyer said they never recieved it and filed a claim.

I provided paypal the shipping info and receipt.

I LOST.

Here is the good part.....the buyer email me a picture of him holding the Magic Johnson photo Titled HA HA.

and paypal said they cant accept the email because its wasnt through ebay.
